Acceptance of terms

Sunrisedevelopment.co.uk is owned and operated by Sunrise Development Limited ("SDL"), a company registered in England and Wales with registered company number 05172912 whose registered office is at Docklands Business Centre 23 Castalia Square, Docklands, London, E14 3NG ("SDL").

Please read this agreement carefully before using the Sunrisedevelopment.co.uk website ("Website"). They represent the terms and conditions ("Terms") for using and placing orders on the Website. Using our Website indicates that you accept the Terms. If you do not agree to these, then do not use our Website. You are permitted to use our Website solely on the basis of these Terms. SDL reserve the right, at our discretion, to update and/or revise these Terms. Please check periodically for changes.

NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS.

THIS IS AN AGREEMENT BETWEEN YOU AND SDL

1. Definitions

In these Terms, the following words and phrases will have the following meanings: "Order" means a purchase order issued by you to us in accordance with these Terms in respect of Products; "Products" means the products which we supply in accordance with these Terms; "Order" means a purchase order in respect of the Products issued by you to us.

2. Use of this Website

2.1 So long as you do so in accordance with these Terms, you may view and download our Website for your personal use only. However, you must note that we may change, suspend or discontinue the Website or the provision of Products under the Website at any time, including the availability of any feature, database, or content. SDL may also impose limits on certain features and services or restrict your access to parts or all of the Website without notice or liability.

2.2 You are responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access or otherwise use the Website, including, without limitation, modems, hardware, software, and long distance or local telephone service.

3. REGISTRATION & SECURITY

3.1 To participate in the Sunrise Development’s solar products online service, to place Orders and to receive Products via the Website, you must:

3.1.2 have a valid credit or debit card in your name;

3.1.3 You must ensure that the details which you provide during registration or at any time after registration are correct and complete.

3.3 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in the “My Account" area of the Website.

4. PRICES & PAYMENT


4.1 The prices which you must pay for the Products that you Order are set out on the Website at the time you place your Order (plus a delivery charge unless you place your Order via the online ordering process on the Website) except where we discover an error in the price of the Products you have ordered. In this event, we will inform you as soon as possible after receiving your Order and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled.

4.2 Prices shown on the Website are inclusive of VAT.

4.3 You will not be charged for items until we accept your Order immediately prior to dispatch. However, please note that we may pre-authorise your Card payment at the time you place your Order with us. We may delay dispatch until receipt of authorisation for payment to be taken from the payment card provided. You can pay by any MasterCard or Visa credit card, Switch or Delta debit card, Solo cards or Electron cards. Your credit/debit card details will be encrypted to protect your personal card information. It is your responsibility to keep your password secure. We reserve the right to modify or withdraw a password at our discretion.

5. ORDER & ACCEPTANCE

5.1 You may place Orders either (i) using the online process for ordering Products via the Website; or (ii) by calling our Customer Services by telephone on 0845 026 4350.

5.2 When you place an Order with us, we need to obtain various details from you so that we can process your Order. You must ensure that the details which you provide each time you place an Order are correct and complete.

5.3 Once you have placed an Order to purchase a product from the Website you will receive an e-mail confirming receipt of your Order and the details of your Order.

5.4 Your Order is an offer to purchase Products from us, which is subject to our acceptance in accordance with these Terms. Our acceptance of your Order and the completion of the contract between you and us will take place upon dispatch to you of the Products ordered and it is at this point that your payment card will be debited. Each separate supply of Products shall constitute a separate contract between us subject to these Terms.

5.8 Therefore all Orders are subject to verification, us receiving payment and also stock availability.

5.9 If the Products ordered are not available, you will be notified by our Customer Services department using the contact details you have provided and you will have the option either to (i) wait until the Products are available from stock; or (ii) cancel your Order.

5.10 Any offers for Products at discounted prices, detailed on the Website, may be made available from time to time for you to Order (subject to our acceptance) for a limited period of time as stated in that offer.

6. DELIVERY

6.1 Delivery will be made to the address specified by you when you place your Order. This may vary from your payment card address.

6.2 We will do our best to secure dispatch within 24 hours of validating the details you provided we are able to obtain funds from your payment card. However, we cannot be held responsible for ensuring stock of each specific Product is available at all times or for delays or failures due to adverse weather, traffic delays. mechanical breakdowns or other circumstances beyond our control. Delivery Charges:

6.2.1 Where you placed your Order using the online process for ordering Products via the Website, delivery is charged please see your fees dependent on location;
Our shipping charges are as follows:
Mainland UK: £3.95 (GBP) for one item, £6.90 (GBP) for two or more items.
Mainland Europe: £7.00 (GBP) per item.
Rest of the World: £12.00 (GBP) per item

6.2.2 Where you placed your Order by calling our Customer Services by telephone on 0845 026 4350, the order will be subject to an additional charge, which will be stated at the time of order.

6.3 Ownership of the Products you Order on the Website shall pass to you on delivery provided that we have processed your card payment and received the full value for such Products.

7. Promotional Points

7.1 Sunrise Development promotes promotional discounts schemes from time to time offering discounted pricings on purchases from the Website.


8. CANCELLATION

You may cancel your Order at any time prior to dispatch by calling our Customer Help Line on (0845 026 4350) or by emailing us on customerservices@sunrisedevelopment.co.uk If you wish to cancel your Order after the Products have been dispatched, you will have to return them to us in accordance with the returns procedure set out in our return policy.

9. RETURNS

9.1 You may return the Product(s) to our please read the return policy on site and below:

9.1.1 If you find a fault with such Product(s) within “reasonable time” 3 days after receiving the package. After delivery provided that we are able to confirm the fault (and in some circumstances, Products may be returned by us to their manufacturer to make such confirmation).

9.1.2 for any reason other than as set out in 9.1.1 above, in its original packaging, unopened and unmarked, and returned in a saleable condition within 14 days of your Order/Purchase being dispatched. We can only accept returns for the full quantity of products originally dispatched.

You must complete the Returns section on the reverse of your Delivery Note, giving a reason for the return. This is important to avoid delay in receiving your refund.

9.1.3 We regret we can only refund return postage costs if the return is clearly because of an error by us or if we decide the product is faulty. This does not affect your statutory consumer rights.

9.1.4 Please note items are your responsibility until it reaches us. For your own protection, we recommend that you send the item via recorded delivery unless the item is worth more than £32 then and only then send them via special delivery with the appropriate cover.

9.2 We will credit your account once the Product(s) has been received by us and has been checked to ensure that the returns policy has been correctly adhered to. Please note that Products can also be returned from the point of purchase.

10. PRIVACY POLICY

Sunrise Development is registered with the Data Protection Registry and take their commitments and obligations under the Data Protection Act 1998 (and any subsequent legislation) very seriously. Customer/User details are treated with the utmost respect and our staff are trained in the observance of the Data Protection Act. Our aim is that your visit to our Website is enjoyable and informative and that you will return to the Site on many more occasions in the future in the knowledge that the privacy of your information or personal data is secure.

10.1 We will not use the personal data which you provide to us otherwise than in accordance with our Privacy Policy which can be accessed by clicking on the hyperlink at the bottom of every page of the website.

10.2 Your email address is essential in order for us to be able to supply you with important information such as order confirmations, notifications about your prescription expiring and changes to the service. By registering with Sunrisedevelopment.co.uk you accept that your email address may be used to supply you with such information.

Under the provisions of the Data Protection Act you have the right to see what information is held concerning you and if you wish to do this, an application in writing should be made to the Data Compliance Officer, Sunrise Development, Unit 3-13 Astra House, 23-25 Arklow Road, London, SE14 6EB. An administration fee of £10 (approximately $20) is required in addition to the written request.

Any changes in our Data Protection Privacy Statement will be notified through this page so that you are always up to date as to how we collect process personal data, how we use the same and more importantly under what circumstances we disclose that information to other parties

11. LIABILITY

11.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or fraudulent misrepresentation.

11.2 In the absence of any negligence or breach of duty by us, your use of any of the Products other than in accordance with their instructions is entirely at your own risk.

11.3 You will be responsible for all liabilities, claims and expenses that arise out of the content you submit post or transmit via the Website, or from your use/misuse of the Website or the use/misuse by any person for whom you are responsible or from your violation of the Terms.

11.4 SDL warrants that it will provide the Products with reasonable skill and care, within a reasonable time, and substantially as described in these Terms. SDL does not make any other promises or warranties about the provision of the Products.

11.5 SDL cannot assume any liability for:

11.5.1 any viruses or any other disabling features that affect your access to or use of the Website;

11.5.2 any incompatibility between the Website and other websites, services, software and hardware;

11.5.3 any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Website;

11.5.4 any modification, suspension or discontinuance of the Website.

11.6 If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.

12. LINKS & ADVERTS

The Website provides links to third party websites and resources. SDL has no control over such websites and resources. Therefore, you should ensure that you carefully read the terms and conditions for the accessing and use of such websites and resources and, if you suffer losses as a result of accessing and/or using such third party websites and resources, you must claim against the third party and not us.

13. INTELLECTUAL PROPERTY RIGHTS

13.1 The content of the Website is protected by copyright, trade mark, database and other intellectual property rights. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from SDL.

13.2 No licence is granted to you in these Terms to use any trade mark of SDL or Sunrise Development Ltd or its affiliated companies.

14. GENERAL

14.1 SDL shall be under no liability for any delay or failure to deliver Products or otherwise perform any obligation as specified in these Terms if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.

14.2 A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act. .

14.3 These Terms are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
